DMCA Policy
How To Roast Beets ("Website") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, How To Roast Beets will respond expeditiously to claims of copyright infringement committed using the How To Roast Beets service and/or the How To Roast Beets website (the "Site") if such claims are reported to How To Roast Beets' Designated Copyright Agent identified below.
This policy describes the information that should be present in a DMCA Notice and Counter-Notice, as well as outlining the procedure for submitting them.
Filing a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to How To Roast Beets' Designated Copyright Agent via the contact methods provided on our Contact Us page. Upon receipt of Notice as described below, How To Roast Beets will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.
Please ensure your Notice includes ALL of the following elements:
- Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
- Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL to the specific page or content).
- Provide information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
- Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Provide your full legal name and your physical or electronic signature (e.g., typing your full name).
Filing a DMCA Counter-Notification
If you believe that the material you posted on the Site was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with us by providing our Designated Copyright Agent with a written counter-notification via the contact methods provided on our Contact Us page.
Please ensure your Counter-Notification includes ALL of the following elements:
- Identify the specific URLs or other unique identifying information of material that How To Roast Beets has removed or to which How To Roast Beets has disabled access.
- Provide your name, address, telephone number, and email address (if available).
- Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
- Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or if I live outside the United States, for any judicial district in which How To Roast Beets may be found), and I will accept service of process from the person who provided the original DMCA notice or an agent of such person."
- Provide your full legal name and your physical or electronic signature (e.g., typing your full name).
Upon receipt of a valid counter-notification, How To Roast Beets will promptly forward it to the party who submitted the original DMCA notification. The original notifying party will then have 10 business days to inform us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Site. If we do not receive such notification within 10 business days, we may, at our sole discretion, reinstate the removed material.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
